Terms and Conditions

CAMPING WEISS – SCHITTERHOF

Operator: S.IN GmbH, Birkachweg 3, 8724 Spielberg, Austria

Version: 07/2024

1. Scope

The following Terms and Conditions comprehensively govern the mutual rights and obligations between the operator of the Schitterhof Campground (hereinafter referred to as the “Campground Operator”) and the campground guest. The contractual services are governed exclusively by the terms and conditions in effect during the period of stay. Telephone agreements, collateral agreements, and other arrangements of any kind must be in writing and confirmed by the campground operator to be valid. Upon registration, the campground guest accepts these General Terms and Conditions.

2. Registration/Reservations

By registering or making a reservation, the camper makes a binding offer to enter into a contract for the provision of a campsite. This may be done in writing (letter, email, or via the website) or, in exceptional cases, verbally or by telephone. The registration is made by the camper on behalf of all fellow travelers listed in the registration/reservation, for whose contractual obligations the camper is liable in the same manner as for their own obligations. The camping contract is not concluded until written confirmation of acceptance is provided or through implied actions by the campground operator or their representatives.

3. Duration of the reservation period and stay

The duration of the period for which a camper makes a reservation is generally binding as soon as the camper begins their stay. It is only possible to shorten the length of stay or the corresponding payment obligation thereafter by mutual agreement. The camper is generally not entitled to a refund of prepaid camping fees if they cut their stay short. If reserved nights are not used (late arrival or early departure), the camper is obligated to pay the applicable pitch fees for the unused nights.

4. Parking space

The selection is made on the day of arrival by mutual agreement. After that, the camper is not permitted to change campsites without the campground operator’s consent. The operator reserves the right to assign guests a different campsite than originally planned, even after a reservation has been confirmed.

5. Prices

The prices listed correspond to the rates in effect at the time the offer was prepared, as stated on the website (www.schitterhof.at). The campground operator reserves the right to make changes or deviations to individual services from the agreed terms of the contract that become necessary after the contract is concluded and that were not caused by the campground operator in bad faith, provided that such changes or deviations are not significant and do not materially affect the overall contract. In any case, without affecting the validity of the camping contract, the campground operator has the right to change the rates in the currently valid price list if more than 4 calendar months elapse between the conclusion of the camping contract and the start of the stay. The camper, for their part, is permitted to withdraw from the contract in accordance with the provisions of Section 6 of these General Terms and Conditions. All price lists are subject to errors and changes.

6. Costs and Cancellation of the Reservation in the Camping Contract

The campground operator reserves the right to accept reservations only after receiving a reservation fee (minimum 100 euros). Campers may cancel their reservation up to eight weeks before the start of their stay. This does not apply to bookings for the Formula 1 and MotoGP event weeks at the Red Bull Ring. The campground operator will refund any amounts paid, minus the aforementioned reservation fee. In the event of cancellation within one week prior to arrival, cancellation fees may apply in the amount of the operator’s interest in performance.

7. Camping Rules

The currently valid campground rules form an integral part of these General Terms and Conditions. They are posted at the campground and are available for download on the campground’s website (www.schitterhof.at). If a campground guest violates the campground rules, the campground operator may expel the guest from the premises. In this case, the guest is not entitled to a refund of any advance payments made. The campground operator reserves the right to claim damages in this case.

8. Payment of the camping fee

The total camping fee for the duration of the booking period is generally due on the day of arrival. Payment must be made in cash or by card. Campers are not entitled to request any other form of payment.

9. Defects

Campers must immediately report any complaints to the campground operator in writing. Claims regarding defects are excluded if they were not reported directly to the campground operator during the camper’s stay. The operator must be given a reasonable period of time to remedy the defect.

10. Liability

The campground operator is not liable for damages resulting from the failure or disruption of water, electricity, or gas supplies, or from noise disturbances caused by third parties. Furthermore, the campground operator is not liable for damages resulting from slightly negligent breaches of duty caused by the use of facilities or equipment located on the premises, or by facilities, equipment, and safety measures that have broken down or are out of service. This also applies to slightly negligent breaches of duty by the campground operator’s legal representatives or vicarious agents.

11. Place of jurisdiction

Austrian law applies. The place of jurisdiction is Leoben, Steiermark.

12. Miscellaneous

We reserve the right to correct any printing, display, or transmitting errors.
